Terms of service

These terms are the agreement between you and RealBrain when you use our websites, your RealBrain account, the RealBrain forum, or any RealBrain product. Please read them. By using any of these services, you agree to them.

1. What these terms cover

These terms apply to:

• the website at realbrain.cc;
• RealBrain accounts at accounts.realbrain.cc, the single sign-in used across RealBrain;
• the community forum at forum.realbrain.cc;
• RealBrain products, including EasySwitch, BG Remover, EasyCap, PineTalk, Artimic, and DMJar.

Some products publish their own terms, refund policy, or licence. Where they do, those documents apply to that product together with these terms, and they take priority if the two conflict.

2. Who can use RealBrain

You must be at least 13 years old, or older if the law where you live requires it, to create a RealBrain account or use our products. If you use RealBrain on behalf of a business or organisation, you confirm that you are authorised to accept these terms for it, and "you" includes that business.

3. Your RealBrain account

• Give us accurate information when you sign up, and keep it up to date.
• Keep your password secret. You are responsible for activity under your account.
• Tell us at [email protected] straight away if you think someone else has accessed your account.
• You can ask us to delete your account at any time. See Data deletion.

4. Acceptable use

You agree not to use RealBrain to:

• break any law, or help anyone else break one;
• send spam, unsolicited bulk messages, or messages that people have not agreed to receive;
• harass, threaten, defraud, or impersonate anyone, or publish content that is hateful, sexually exploitative, or that infringes someone else's rights;
• upload malware, probe or attack our systems, or get around rate limits, security, or access controls;
• scrape or copy our services in a way that overloads them, or resell them without our written permission.

We may remove content or limit an account that breaks these rules.

5. Content you post on the forum

You keep ownership of what you post. By posting, you give RealBrain a worldwide, non-exclusive, royalty-free licence to host, display, and distribute that content as part of the forum. Forum threads are public: anyone can read them without signing in, and search engines index them. Do not post private information such as passwords, payment details, or other people's personal data. We may edit or remove posts that break these terms or the law.

6. DMJar and Meta platforms

DMJar is a RealBrain product that lets businesses answer customer messages on their Facebook Page through Messenger, with replies drafted by AI. If you connect a Facebook Page to DMJar:

• you confirm that you administer the Page and are allowed to connect it;
• you must follow Meta's Platform Terms, the Developer Policies, Messenger's messaging policies, and the laws that apply to your business, including consumer-protection and e-commerce rules;
• you are responsible for the information you give DMJar about your business (products, prices, delivery areas, policies) and for the replies sent from your Page, including replies you approve or send yourself;
• you must tell your customers, for example in your Page's information or your own privacy notice, that you use an automated assistant to reply to messages;
• we process your customers' messages only to provide DMJar to you, as described in our Privacy policy;
• you can disconnect your Page at any time. See Data deletion for what happens to the data afterwards.

DMJar is not made, endorsed, or sponsored by Meta. Facebook and Messenger are trademarks of Meta Platforms, Inc.

7. Paid products and payments

Prices, what a plan includes, and any trial or refund terms are shown at the point of purchase and in the product's own pages. Payments are handled by third-party payment processors. We do not see or store your full card details. Unless the product's refund policy says otherwise, or the law requires it, payments are not refundable.

8. Client projects

Custom development, AI, and mobile work that we take on for clients is governed by a separate written proposal or agreement for that project. These terms apply to the extent that agreement does not cover something.

9. Our intellectual property

RealBrain's software, websites, designs, logos, and product names belong to MD. SHARIFUL ISLAM trading as RealBrain, or to our licensors. Using RealBrain gives you a limited, personal, non-transferable right to use our products as intended. It does not give you ownership of them or any right to use our brand.

10. Third-party services

RealBrain links to and integrates with services we do not control, such as Meta's platforms, Google, Cloudflare, and payment processors. Their own terms apply to your use of them, and we are not responsible for them.

11. Privacy

Our Privacy policy explains what information we collect and how we use it. It is part of these terms.

12. Disclaimers

We work hard to keep RealBrain reliable, but our services are provided "as is" and "as available". As far as the law allows, we make no promise that they will be uninterrupted or error-free, or that AI-generated replies will always be accurate. Check important information before you rely on it.

13. Limitation of liability

As far as the law allows, RealBrain is not liable for indirect or consequential losses, such as lost profits, revenue, or data. Our total liability for any claim about our services is limited to the amount you paid us for that service in the 12 months before the claim, or USD 100 if you paid nothing. Nothing in these terms limits liability that cannot be limited by law, or your rights as a consumer that the law says cannot be waived.

14. Suspension and termination

You can stop using RealBrain at any time. We may suspend or close an account that breaks these terms, puts other users or our systems at risk, or where the law requires it. Where it is reasonable, we will tell you first and explain why.

15. Changes to these terms

We may update these terms as our products change. We will change the date at the top of this page, and for significant changes we will give notice on the website or by email. If you keep using RealBrain after a change takes effect, you accept the updated terms.

16. Governing law

These terms are governed by the laws of Bangladesh, and disputes will be handled by the courts of Bangladesh. If you are a consumer, you also keep any protections the law of your own country gives you.
